This Privacy Policy also explains certain privacy choices and rights that may be available to you under applicable law.

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. Scope of This Privacy Policy

This Privacy Policy applies to information we collect:

  • Through Shrugbuds-operated websites, including shrugbuds.com;

  • When you purchase products, memberships, or other offerings through an authorized commerce platform;

  • When you link, authenticate, or otherwise use a Twitch account or another supported account with the Services;

  • When you purchase, receive, view, or use Shrugbits or Drops;

  • When you participate in livestreams, community features, video submissions, voting, leaderboards, or other interactive experiences;

  • When you contact us, subscribe to updates, or otherwise communicate with us; and

  • Through authorized third-party platform integrations that we use to operate the Services.

This Privacy Policy does not apply to third-party websites, platforms, products, or services that we do not own or control, including Twitch, Fourthwall, YouTube, Google, Meta, payment providers, and other third-party services. Their collection and use of information are governed by their own terms and privacy policies.

2. Personal Information We Collect

The Personal Information we collect depends on how you use the Services.

A. Information You Provide Directly

We may collect Personal Information that you provide directly to us.

Account and Contact Information

This may include:

  • Name;

  • Email address;

  • Mailing address;

  • Phone number;

  • Account identifiers;

  • Usernames, display names, or credits names;

  • Information you provide when creating, linking, verifying, recovering, or managing an account; and

  • Information you provide in support requests or communications with us.

Twitch and Linked-Account Information

When you link, authenticate, or use a Twitch account or another supported account with Shrugbuds, we may collect or receive:

  • Twitch user ID;

  • Twitch username or login;

  • Twitch display name;

  • Account-linking and verification status;

  • Internal account identifiers; and

  • Information needed to associate an eligible account with memberships, Shrugbits, Drops, or interactive features.

We use authorized account-linking methods and do not ask you to provide your Twitch password to Shrugbuds.

Purchases, Memberships, and Transaction Information

When you make or attempt to make a purchase, register for a membership, receive a membership benefit, or otherwise transact through the Services, we may collect or receive:

  • Name, email address, mailing address, phone number, or other information required by the applicable checkout flow;

  • Order identifiers;

  • Transaction date and amount;

  • Product, membership, or offering purchased;

  • Subscription or membership tier;

  • Membership status;

  • Billing status;

  • Refund, cancellation, chargeback, reversal, or payment-dispute information; and

  • Transaction history and related records.

Payment-card information is collected and processed by authorized commerce or payment providers. We may receive limited transaction-related information from those providers, such as payment status, order details, subscription status, refunds, chargebacks, and related timestamps.

Shrugbits, Drops, and Interactive-Feature Information

Shrugbits are creator-support participation features that may include an allowance of available Drops for eligible livestream interactions.

When you purchase, receive, view, or use Shrugbits, Drops, or interactive features, we may collect or generate records relating to:

  • Your Shrugbits account records;

  • Your available Drops;

  • Shrugbits purchases, grants, membership allocations, and promotional awards;

  • Drop activations, requests, reversals, refunds, adjustments, corrections, and related timestamps;

  • Account-linking information associated with Shrugbits or Drops;

  • Interactive-feature requests;

  • Queue, cooldown, eligibility, moderation, or feature-status information;

  • Leaderboard, voting, participation, and season-related records; and

  • Fraud, abuse, support, and account-dispute records.

Video Submissions and Community Participation

When you participate in Total Chaos Live or other community features, we may collect information such as:

  • YouTube or other submitted video URLs;

  • Video titles, thumbnails, descriptions, and other information associated with submitted content;

  • Submission time and status;

  • Eligibility, moderation, queue, cooldown, and playback-status information;

  • Voting activity;

  • Leaderboard participation; and

  • Messages, comments, reports, or content you submit through the Services.

Communications

When you contact us, subscribe to newsletters, respond to a survey, submit a support request, or otherwise communicate with us, we may collect:

  • Your name;

  • Contact information;

  • The content of your message;

  • Attachments or other information you choose to provide; and

  • Information needed to respond to or resolve your request.

You are not required to provide all Personal Information described in this Privacy Policy. However, certain Services or features may not be available if you do not provide information needed to use them.

We and our service providers may automatically collect certain information when you use the Services.

Log and Technical Information

We may infer your general geographic location from your IP address or other technical information. We do not intentionally collect precise geolocation information unless we expressly notify you at or before collection.

We and our service providers may use cookies, pixels, local storage, clear GIFs, tags, and similar technologies to:

  • Operate and secure the Services;

  • Twitch and other authentication or streaming platforms, when you link, authenticate, or use a third-party account with our Services;

  • Commerce and membership providers, including Fourthwall, when you make a purchase, subscribe, cancel, receive a refund, or otherwise interact with an authorized checkout or membership platform;

  • Payment providers used by authorized commerce platforms, in connection with payment status, fraud prevention, refunds, chargebacks, or disputes;

  • Analytics and measurement providers, including Google and Meta;

  • Email, customer-support, security, fraud-prevention, hosting, database, and infrastructure providers that support our Services;

  • Users, moderators, or community participants, where they submit content, report activity, or otherwise participate in community features; and

  • Professional advisers, law-enforcement agencies, or government authorities, where permitted or required by law.

3. Public Stream and Community Display

Shrugbuds is an interactive community and livestream experience. When you use certain features, information associated with your account or participation may be displayed publicly.

For example, we may publicly display:

  • Your Twitch username or display name;

  • A credits name or other name you choose to use;

  • Your submitted video, video title, thumbnail, or URL;

  • Your Drop activation or other livestream interaction;

  • Your leaderboard position;

  • Your voting activity or other community participation;

  • Your membership acknowledgment, where applicable; and

  • Your messages, content, or other information you intentionally submit for public participation.

This information may appear in:

  • Livestreams;

  • On-screen overlays;

  • Leaderboards;

  • Queue displays;

  • Credits;

  • Community acknowledgments;

  • Video-on-demand archives;

  • Clips;

  • Screenshots;

  • Social-media posts; and

  • Other related Shrugbuds content.

Please do not use a display name, credits name, submitted video, or other content that you do not want publicly displayed.

Publicly displayed information may remain visible in livestream recordings, VODs, clips, screenshots, reposts, or other content after the relevant livestream or feature has ended.

4. How We Use Personal Information

We may use Personal Information for the following purposes:

  • To provide, operate, maintain, improve, and enhance the Services;

  • To create, authenticate, link, verify, and maintain accounts;

  • To process purchases, memberships, transactions, refunds, cancellations, chargebacks, and payment disputes;

  • To associate eligible accounts with memberships, Shrugbits, available Drops, and interactive features;

  • To calculate, display, reconcile, correct, audit, and otherwise manage Shrugbits, available Drops, and related account records;

  • To process membership-related Drop allowances and other authorized grants;

  • To process livestream-interaction requests, Drop activations, video submissions, voting, leaderboards, queue requests, and other community features;

  • To apply feature-specific rules, eligibility requirements, moderation decisions, queue rules, cooldowns, and technical limitations;

  • To communicate with you, respond to your questions, provide customer support, and send service-related messages;

  • To send newsletters, updates, offers, announcements, and other marketing communications where permitted by law and consistent with your preferences;

  • To understand and analyze how visitors use the Services;

  • To improve the performance, reliability, safety, and usability of the Services;

  • To diagnose errors, maintain security, and prevent abuse;

  • To investigate and prevent fraud, payment abuse, account abuse, bots, automation, duplicate claims, policy violations, and other harmful activity;

  • To enforce our Terms of Service, Shrugbits Policy, community rules, and other agreements;

5. Aggregated and De-Identified Information

We may aggregate or de-identify Personal Information so that it can no longer reasonably identify you.

  • Measure community participation;

  • Conduct research;

  • Prepare internal reports;

  • Understand user trends; and

  • Share high-level, non-identifying statistics with service providers, business partners, sponsors, or others.

We will maintain and use de-identified information in de-identified form and will not attempt to reidentify it except where permitted or required by applicable law.

Service Providers and Authorized Integrations

We may disclose Personal Information to vendors, contractors, and service providers that support the Services, including providers of:

  • Commerce and membership services, including Fourthwall;

  • Payment processing;

  • Account authentication and streaming-platform integration, including Twitch;

  • Cloud hosting, databases, content delivery, infrastructure, and security;

  • Analytics and measurement;

  • Email and communications;

  • Customer support;

  • Fraud prevention;

  • Moderation and operational support; and

  • Legal, accounting, tax, and professional services.

Public Community and Stream Displays

As described in Section 3, information associated with public community, livestream, video-submission, leaderboard, voting, Drop activation, or interactive features may be displayed publicly.

Legal, Safety, and Enforcement Purposes

We may disclose Personal Information where we reasonably believe disclosure is necessary or appropriate to:

  • Comply with applicable law, regulation, subpoena, court order, or governmental request;

  • Protect the rights, safety, security, or property of Shrugbuds, our users, our personnel, or the public;

  • Detect, investigate, prevent, or address fraud, abuse, security incidents, or violations of our policies;

With Your Direction or Consent

7. Analytics, Measurement, and Advertising Technologies

We use analytics and measurement technologies to understand how visitors use the Services, improve site performance, diagnose technical issues, measure engagement, and better understand aggregate visitor activity.

Google Analytics

We use Google Analytics to measure website traffic and usage. Google Analytics may collect information such as browser and device information, approximate location inferred from IP address, pages viewed, session activity, referring pages, and pseudonymous identifiers stored in cookies or similar technologies.

Meta Pixel

We use the Meta Pixel to measure activity on the Services, such as page views, visits, interactions with site features, and other website events. Meta may receive information generated through the Pixel, including device, browser, cookie, and website-activity information, subject to Meta’s applicable terms and privacy policies.

Our Current Use

At this time, we use Google Analytics and the Meta Pixel for website analytics and measurement.

We do not currently use these tools to:

  • Run paid advertising campaigns;

  • Create website retargeting audiences;

  • Upload subscriber lists or customer lists to Google or Meta for targeted advertising;

  • Create lookalike audiences;

  • Use website activity to deliver paid advertisements to visitors; or

  • Use customer email addresses for Google or Meta audience matching.

If our use of these technologies materially changes, including if we begin using them for targeted advertising, retargeting, audience matching, or advertising personalization, we will update this Privacy Policy and provide any additional notices, choices, or consent mechanisms required by applicable law.

Email Marketing

If you choose to receive marketing emails, we may use your email address and email-engagement information to send newsletters, updates, announcements, offers, and other communications from Shrugbuds.

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in the email or by contacting us at shrugbuds@gmail.com.

Sending marketing emails to subscribers is separate from targeted advertising. We do not currently upload subscriber email lists to Google or Meta for advertising audiences.

8. Your Privacy Choices

Marketing Emails

You may unsubscribe from marketing emails at any time by selecting the unsubscribe link in a marketing email or by contacting us at shrugbuds@gmail.com.

Even if you opt out of marketing emails, we may still send you non-marketing communications, including purchase confirmations, membership notices, account messages, security notices, support responses, and policy updates.

Browser Controls

You may manage certain cookies and similar technologies through your browser settings. You may also use the Google Analytics Opt-Out Browser Add-On, where available.

9. Data Retention

Retention periods vary depending on the type of information, the nature of the relationship, and our legal or operational needs.

  • Account and account-linking information may be retained while an account is active and afterward as needed for support, security, legal, and fraud-prevention purposes.

  • Shrugbits, Drops, purchases, membership allocations, and transaction records may be retained as needed for accounting, tax, fraud prevention, payment disputes, chargebacks, technical corrections, enforcement, and legal obligations.

  • Membership records may be retained during the membership lifecycle and afterward as needed for billing, cancellation, refund, chargeback, accounting, and dispute-resolution purposes.

  • Video-submission, queue, moderation, and interactive-feature records may be retained as needed to operate the feature, enforce rules, investigate abuse, and resolve disputes.

  • Security and technical logs may be retained for a shorter operational period unless needed for an investigation, legal matter, or security purpose.

  • Public livestream recordings, VODs, clips, screenshots, and social posts may remain available according to our content-retention practices even if you later close an account or request deletion of certain Personal Information.

When Personal Information is no longer needed, we may delete, anonymize, aggregate, or otherwise de-identify it, unless retention is required or permitted by law.

10. Account Closure and Deletion Requests

Deleting or closing an account may:

  • Prevent access to your account;

  • Prevent account linking or authentication;

  • Prevent access to memberships, available Drops, dashboards, submissions, and interactive features;

  • Prevent future participation in community features; and

  • Result in the loss of certain account-associated functionality.

We may retain certain information after an account-closure or deletion request where necessary or permitted for:

  • Legal compliance;

  • Tax and accounting;

  • Security;

  • Fraud prevention;

  • Chargebacks and payment disputes;

  • Enforcement of agreements;

  • Technical correction;

  • Legal claims;

  • Recordkeeping; and

  • Publicly available livestream, VOD, clip, screenshot, or social-media content.

11. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect Personal Information.

However, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security of Personal Information.

You are responsible for maintaining the security of your own account credentials and linked accounts. Please notify us promptly if you believe your account has been accessed without authorization.

12. Children’s Privacy

The Services are not directed to children under 13 years of age.

Shrugbuds is based in the United States. We and our service providers may process, store, or transfer Personal Information in the United States and other countries that may have privacy laws different from those in your country of residence.

We do not sell Personal Information for money.

Depending on how analytics and measurement technologies are configured, disclosure of identifiers and internet or electronic network activity information to analytics and measurement providers, including Google and Meta, may be considered a “sale” or “sharing” of Personal Information under the CCPA.

Financial Incentives

We do not currently offer a financial incentive program in exchange for Personal Information.

If we introduce a referral program, bonus program, promotional incentive, or other program that qualifies as a financial incentive under applicable law, we will provide a separate notice describing the material terms of that program.

Do Not Track

Some browsers offer a “Do Not Track” setting. Because there is no uniform industry standard for responding to Do Not Track signals, we do not currently respond to browser-based Do Not Track signals.
