Shrugbits Support Packs and Drops Policy

This Shrugbits Support Packs and Drops Policy (“Policy”) explains how Shrugbits Support Packs, membership-related Drops, and other eligible livestream participation features may be offered, received, associated with an account, used, adjusted, and managed through Shrugbuds Services.
This Policy is incorporated into and forms part of the Shrugbuds Terms of Service. By purchasing a Shrugbits Support Pack, receiving or using Drops, accessing a membership benefit, or otherwise using Shrugbits features, you agree to this Policy, the Terms of Service, and the Privacy Policy.
In this Policy, “Shrugbuds,” “we,” “us,” and “our” mean Shrugbuds, LLC.
1. Scope of This Policy
This Policy applies to Shrugbits features made available through Shrugbuds-operated websites, livestreams, dashboards, community experiences, and authorized third-party platform integrations made available by Shrugbuds (collectively, the “Services”).
Authorized integrations may include account-authentication, commerce, streaming, moderation, playlist, and other third-party services that Shrugbuds elects to use from time to time.
Third-party platforms, payment providers, and integrations may have their own terms, privacy policies, eligibility rules, technical requirements, and service limitations. Your use of those third-party services is subject to their applicable terms and policies in addition to this Policy.
2. What Shrugbits and Drops Are
Shrugbits is the name of Shrugbuds’ creator-support and livestream participation program.
Eligible Shrugbits Support Packs, memberships, promotions, or community grants may include a stated number of Drops.
A Drop is a limited, personal, non-transferable permission to request an eligible creator-controlled livestream interaction or participation feature through the Services.
Drops may be used only for eligible Shrugbuds livestream features, subject to the applicable stream rules, moderation requirements, availability, technical limitations, cooldowns, queue rules, and other feature-specific conditions.
Shrugbits and Drops are intended to let supporters participate in optional livestream experiences while supporting Shrugbuds.
3. Shrugbits and Drops Are Not Money or Stored Value
Shrugbits and Drops:
-
Have no cash value.
-
Are not legal tender.
-
Are not currency, cryptocurrency, a token, a financial asset, a payment instrument, a bank account, a gift card, store credit, or an investment.
-
Are not redeemable for money, cash equivalents, gift cards, merchandise, third-party services, or anything of value outside Shrugbuds.

May not be used as a general-purpose payment method.

Do not create a deposit, account balance payable in money, investment interest, or monetary claim against Shrugbuds.

Do not create an ownership interest or property right in Shrugbits, Drops, the Services, or any particular stream feature, interaction, result, or benefit.
Obtaining a Shrugbits Support Pack, membership-related Drop allowance, or other Drop grant gives you only a limited, personal, revocable, non-exclusive, non-transferable right to request eligible livestream activations as expressly permitted through the Services, this Policy, and the Terms of Service.
4. Eligible Livestream Activations
Drops may be used only through features expressly made available by Shrugbuds.
Eligible Drop activations may include requests to:

Activate approved livestream interactions or effects;
-
Trigger eligible Creepies, potions, teleportation, Stiltskin, or similar livestream features;
-
Contribute to an eligible Chaos Meter or Total Chaos event;
-
Extend an eligible Total Chaos event;
-
Request priority handling for an eligible Total Chaos Live video submission;
-
Participate in other creator-controlled livestream interactions or community features designated by Shrugbuds.
These examples are illustrative only. They do not guarantee that any listed feature is currently available, will remain available, or will be available to every user.
All Drop requests are subject to then-current:

Eligibility requirements;
-
Stream rules;
-
Moderation standards;
-
Content requirements;
-
Community guidelines;
-
Availability;
-
Queue capacity;
-
Cooldowns;
-
Technical limitations;
-
Operational requirements; and
-
Feature-specific rules.
For example, a request for priority handling of a video submission may be subject to content review, submission requirements, moderation, queue capacity, timing, stream format, cooldowns, technical limitations, and other rules that apply at the time of the request.
Using a Drop does not guarantee:

That a requested interaction will occur at a particular time;
-
That a submitted video will play at a particular time or in a particular position;
-
That a requested effect will appear on-screen;
-
That a host, moderator, or other participant will respond;
-
That a stream, feature, dashboard, integration, or interaction will remain available or uninterrupted;
-
Any particular entertainment outcome, voting result, leaderboard result, or audience response.
Where a verified technical error prevents a valid Drop request from being processed as intended, Shrugbuds may investigate and, where appropriate, restore, replace, or adjust the affected Drop or feature access.
5. Support Packs, Memberships, and Authorized Checkout
Shrugbuds may offer Shrugbits Support Packs, memberships, or other creator-support offerings through authorized Shrugbuds checkout or commerce platforms.
An eligible Support Pack or membership may include a stated number of Drops, as disclosed at the time of purchase or enrollment.
Before purchase, Shrugbuds or the authorized checkout provider will display the applicable price, included benefits, stated Drop allowance where applicable, and other material purchase details made available for that transaction.
Purchases may be subject to:

Applicable taxes, fees, and payment-provider charges disclosed at checkout;
-
The terms of the applicable checkout or commerce platform;
-
Payment verification and fraud-review procedures;
-
Account-linking or authentication requirements;
-
Geographic, age, eligibility, or platform restrictions; and
-
Membership-specific or feature-specific terms disclosed at checkout.
Shrugbuds may change available Support Packs, membership benefits, Drop allowances, prices, eligible features, and the number of Drops required for an eligible activation prospectively.
Shrugbuds does not guarantee that a particular interaction, feature, or benefit will always require the same number of Drops.
6. Account Association, Authentication, and Privacy
Drops may be associated with one or more account identifiers, including:

A Twitch account or Twitch user ID;
-
An email address;
-
A Shrugbuds account;
-
Membership, purchase, or subscription records; and
-
Other account identifiers or authentication credentials designated by Shrugbuds.
To receive, view, or use Drops, you may be required to link or verify an eligible Shrugbuds account, Twitch account, email address, or other identifier as instructed by Shrugbuds.
You are responsible for:
-
Providing accurate account information;
-
Maintaining access to linked accounts;
-
Keeping your email and authentication details current;
-
Protecting your account credentials; and
-
Promptly notifying us if you believe your account, available Drops, or related account records have been accessed without authorization.
Shrugbuds’ collection, use, storage, and sharing of account, purchase, membership, and integration-related information is described in the Shrugbuds Privacy Policy.
7. Available Drops and Account Records
You may be able to view your available Drops and certain related activity through a Shrugbuds dashboard or another designated location within the Services.
Displayed Drop allowances, account records, membership allocations, activation status, or feature status may be delayed or temporarily unavailable because of payment verification, account-linking status, fraud review, technical maintenance, third-party platform delays, or service interruptions.
Shrugbuds may correct, remove, reverse, or adjust available Drops or related records where reasonably necessary to address:

A technical error;
-
A duplicate transaction;
-
A failed or reversed payment;
-
A refund, chargeback, or payment dispute;
-
Fraud, abuse, exploitation, or unauthorized access;
-
A violation of this Policy, the Terms of Service, or applicable law; or
-
An incorrectly issued membership allowance, award, promotion, or feature result.
Subject to applicable law, Shrugbuds’ records will control in the event of a dispute regarding an available Drop, Support Pack, membership benefit, or related transaction, unless we determine that a correction is appropriate.
8. Membership-Related Drop Allowances
Certain Shrugbuds memberships may include recurring Drop allowances.
To receive or use membership-related Drops, you may be required to:

Maintain an active and paid eligible membership;
-
Link or verify the applicable Shrugbuds, Twitch, email, or other account identifier;
-
Meet the eligibility requirements of the applicable membership tier; and
-
Complete any required payment verification or account setup.
Membership-related Drop allowances may be subject to processing time, payment verification, account-linking status, payment-provider processing, and third-party platform delays.
Unless the applicable membership terms state otherwise, cancellation of a membership stops future membership-related Drop allowances but does not itself reverse Drops that were properly granted before cancellation.
Shrugbuds may remove or adjust previously granted Drops if the underlying membership payment is reversed, refunded, charged back, fraudulent, or otherwise invalid.
Membership price, billing frequency, automatic-renewal terms, cancellation method, benefits, and tier-specific eligibility requirements will be disclosed through the applicable membership offer and checkout flow.
9. No Expiration While Your Account Is Active
Drops do not expire while your account remains active and in good standing.
Shrugbuds may remove or adjust Drops where permitted by this Policy or applicable law, including in connection with fraud, abuse, payment reversal, account suspension, account termination, technical correction, or violation of the Terms of Service.
If Shrugbuds discontinues Shrugbits, Drops, a particular feature, or the Services, we may provide notice where required by applicable law. Drops remain non-redeemable for cash or anything of value outside the Services.
10. Refunds, Cancellations, and Chargebacks
Except where required by applicable law or expressly stated at the time of purchase:

Purchases of Shrugbits Support Packs and related offerings are final.

Included or granted Drops are non-refundable.
-
Unused Drops do not create a right to a cash payment, refund, exchange, store credit, or compensation.

Canceling a membership does not entitle you to a refund for Drops previously granted through that membership.
-
A payment reversal, chargeback, fraud finding, or refund may result in the removal or adjustment of related Drops.
Shrugbuds may provide a replacement, courtesy adjustment, refund, or other resolution where we determine that it is appropriate. Any such action is discretionary and does not create an obligation to provide the same outcome in future situations.
11. No Resale, Trading, or Unauthorized Transfers
Except through an official Shrugbuds feature expressly authorized by us, you may not:

Sell, buy, broker, auction, trade, barter, exchange, or transfer Drops;
-
Attempt to exchange Drops for money, cryptocurrency, merchandise, gift cards, memberships, services, or anything else of value;
-
Purchase Drops from another user or third party;
-
Allow another person to access, use, or control your account in order to use your Drops; or
-
Circumvent account limits, eligibility rules, anti-fraud controls, or feature-specific restrictions.
Any attempted unauthorized sale, transfer, exchange, or transaction is void and may result in suspension or termination of the applicable account, removal of Drops, and other action permitted under the Terms of Service and applicable law.
12. Official Community Grants and Sponsored Drops
Shrugbuds may offer official community grants, sponsored Drop programs, membership gifts, or similar creator-controlled community features.
Where Shrugbuds offers an official feature of this kind, Shrugbuds may grant the applicable Drops or membership benefit directly to an eligible recipient.
This does not create a general right for users to transfer their existing Drops to another user.
Official community grants, sponsored Drops, membership gifts, and similar features may be subject to separate eligibility requirements, geographic restrictions, age requirements, verification procedures, timing limitations, feature-specific rules, and official promotion rules.
Shrugbuds may cancel, deny, reverse, or modify an award, grant, or benefit where we reasonably believe there has been fraud, abuse, ineligibility, a payment reversal, technical error, or a violation of this Policy, the Terms of Service, official rules, or applicable law.
13. Randomized Livestream Features and Promotions
Shrugbuds may offer interactive livestream features with randomized or unpredictable entertainment outcomes.
Unless separate official promotion rules expressly provide otherwise, a randomized livestream feature does not offer a prize, cash, merchandise, gift card, membership, or other item of real-world value.
Shrugbuds will not require a person to purchase a Support Pack, use Drops, make a purchase, or maintain a membership in order to enter or improve their odds of winning a chance-based giveaway or promotion involving a prize.
Any chance-based promotion involving a prize may be governed by separate official rules. Those rules may include eligibility criteria, entry instructions, a free method of entry where required, start and end dates, prize details, approximate retail value, odds information where applicable, sponsor information, geographic restrictions, and other legally required disclosures.
14. Prohibited Conduct and Enforcement
Shrugbuds may suspend, restrict, terminate, or otherwise act on an account if we reasonably believe the account has engaged in:

Fraud, payment abuse, chargebacks, deception, or attempted theft;
-
Bots, scripts, automation, account farming, or artificial engagement;
-
Unauthorized transfers, resale, trading, or third-party Drop transactions;
-
Attempts to exploit technical errors, moderation systems, queue systems, available Drops, or feature rules;
-
Circumvention of eligibility requirements, cooldowns, account limits, or anti-fraud measures;
-
Harassment, unlawful conduct, harmful conduct, or violations of community rules; or
-
Violations of this Policy, the Terms of Service, or applicable law.
Where permitted by applicable law, Shrugbuds may remove or adjust associated Drops as part of an enforcement action.
15. Availability, Modifications, and Discontinuation
Shrugbuds does not guarantee continuous availability of any particular stream, feature, interaction, integration, dashboard, leaderboard, Chaos Meter, Total Chaos event, submission opportunity, voting feature, membership benefit, Support Pack, Drop allowance, or Drop activation.
Features may be modified, replaced, paused, delayed, limited, disabled, renamed, or discontinued at any time.
Shrugbuds is not responsible for an inability to use Drops caused by circumstances outside our reasonable control, including:

Internet connectivity issues;
-
Twitch or other third-party platform outages;
-
Account-authentication issues;
-
Checkout, payment-processor, or commerce-platform outages;
-
Device, browser, software, or account issues;
-
Stream interruptions;
-
Content moderation decisions;
-
Technical maintenance; or
-
Force majeure events.
16. Disclaimer and Limitation of Liability
To the maximum extent permitted by applicable law, Shrugbuds and its owners, affiliates, licensors, service providers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to Shrugbits, Drops, Support Packs, memberships, or the Services.
This includes claims relating to lost enjoyment, lost opportunities, loss of access, service interruption, inability to use a feature, account issues, technical errors, third-party platform issues, or a feature not producing a requested or expected result.
To the maximum extent permitted by applicable law, Shrugbuds’ total liability arising from or related to Shrugbits, Drops, Support Packs, memberships, or the Services will not exceed the amount you paid directly to Shrugbuds for the offering giving rise to the claim during the twelve (12) months before the event giving rise to the claim.
Nothing in this Policy limits rights or remedies that cannot legally be limited or excluded.
17. Changes to This Policy
Shrugbuds may update this Policy from time to time.
When we make a material change, we may provide notice by posting the updated Policy, updating the “Last Updated” date, sending an email to the address associated with your account, providing notice through the Services, or using another reasonable method.
Your continued use of Shrugbits, Drops, or the Services after the effective date of an updated Policy means that you accept the updated Policy to the extent permitted by applicable law.
